Debt Collection Defense

How do they make their money?    Many debt collection lawsuits are ignored by the consumer.    When the consumer ignores the lawsuit, the debt buyer then obtains a default judgment.    After obtaining a default judgment, the debt buyer is then able to garnish your wages , seize bank accounts, and seize non-exempt assets to satisfy the judgment, if he chooses to do so.

If you have been sued by a debt collector, it is essential that you do not ignore the lawsuit.     Simply put, if you ignore the lawsuit, YOU LOSE.     You do not get to tell the court your side of the story.  You give up your right to force the debt buyer to prove its claims in a court of law.      Ignoring a debt collection lawsuit will not make it go away.

Even if you feel like you owe the debt, you should seek the advice of an attorney if you are served with a debt collection lawsuit.   Many times, the debt collector adds interest or fees that are illegal or unauthorized by law. Frequently, the debt buyer does not have the documentation and evidence needed to prove its claims in a court of law.   Other times, the debt may be prescribed (beyond the statute of limitations).

Even if it is determined the debt collector can prove its claims, many times a settlement can be worked  settle the debt for less than legally is owed.

Debt collectors and debt buyers make a lot of money off uninformed consumers who ignore debt collection lawsuits.     Do NOT be one of them.
